COMMON JUDGMENT
JUSTICE SHRI. K.R. UDAYABHANU: PRESIDENT
Both the matters are with respect to the alleged failure on the part of the opposite party/KSEB in not producing the documents sought to be produced by the complainant, ie the minimum guarantee agreement etc. Revision-10/11 is with respect to the order in I.A.1186/09 filed by the complainant who is conducting the case in person to take action against the opposite parties under Section 27 of the Consumer Protection Act. The Forum has dismissed the above application observing that invoking of section 27 is not necessary.
2. Revision petition-11/2011 is with respect to the order in I.A.1185/09 wherein he has sought for assistance of the Police Vigilance to procure the documents. The Forum has dismissed the same also and directed the KSEB to produce the documents.
3. The complainant/Revision petitioner has also pleaded that the Forum ought to have provided cost as the matter has been adjourned for about a dozen times.
4. In the circumstances the Forum is directed to see that the matter is disposed of at the earliest at any rate within 6 months from the date of receipt of this order and also to see that the opposite parties are ordered to pay cost if the matter is protracted on account of the lapse of the opposite parties to produce documents etc. Revision petition is disposed of as above.
Office will forward a copy of this order to the Forum.
