NAWAB SINGH J, (ORAL)

By filing this revision petition, DHFL Pramerica Life Insurance Company Limited-opposite parties (petitioners herein) have challenged the order dated December 07th, 2017 passed by the District Consumer Disputes Redressal Forum, Rewari (for short ‘District Forum’) whereby their application to summon Dr. M.M. Talwar and Dr. Suraj Chaudhary, Talwar Nursing Home, Sirsa, was dismissed.

2.      It is the case of the petitioners that Phool Singh (Deceased Life Insured) was suffering from acute depression.  He committed suicide due to depression.  So, evidence of Dr. M.M. Talwar and Dr. Suraj Chaudhary, Talwar Nursing Home, Sirsa is required to adjudicate the matter in a more complete and effective manner.

3.      Be that as it may and considering the golden principle that everyone approaching the temple of justice should feel satisfied in the matter of getting opportunity to present his or her case as good as he or she can, this revision petition is accepted and impugned order is set aside.

4.      It is recorded for the sake of clarity that the District Forum is asked to take oral evidence of Dr. M.M. Talwar and Dr. Suraj Chaudhary, Talwar Nursing Home, Sirsa and complainant would also be granted opportunity to rebut the same.

5.      Copy of this order be sent to the District Forum.
