BY SRI. RAVISHANKAR, JUDICIAL MEMBER.

          This appeal is filed by the appellant/Opposite Party being aggrieved by the order dated:17/02/2017 passed by the Bangalore Urban District Consumer Commission in C.C.No.2137/2014, wherein the District Commission allowed the complaint filed by the complainant by directing this appellant to refund an amount of Rs.27,392/- and also directed to pay Rs.75,000/- towards compensation and Rs.5,000/- towards costs.

2.       Case called thrice, none appeared for appellant and appellant also not present. The appellant did not present before this Commission since long time to take steps to bring the respondent.  We consider the appellant is not interested in continuing the case. Mere filing of memorandum of appeal is not sufficient to hold the appeal in the absence of any arguments and convincement by the appellant. As such the appeal is liable to be dismissed.  Accordingly, the appeal is dismissed.

The amount in deposit shall be transmitted to the concerned District Commission to pay the same to the complainant. 

          Forward copy of this order to both parties as well as concerned District Commission. 

Return the LCR forthwith to the concerned District Commission.
