Heard Mr.Mehta, Advocate for the appellant and Mr.R.S. Jadhav, Advocate for the respondent No.1/org. complainant.  Appellant makes an endorsement on the appeal memo and convey that the amount deposited as a condition for stay and under proviso of Section 15 of Consumer Protection Act, 1986 be paid to the respondent No.1-Sunita Pramod Londhe/org. complainant along with whatever interest accrued thereon, if the amount is kept in the Fixed Deposit.  Learned Counsel for respondent No.1 filed a pursis stating that they are willing to accept said amount deposited as aforesaid along with interest as accrued towards full and final settlement of the claim.  Said pursis is marked as Exhibit-X1.  Hence, we pass the following order:-

                            -: ORDER:-

1.      Appeal a/w. Misc. Application for condonation of delay stands dismissed as withdrawn.

2.      No order as to costs.

3.      The amount deposited as a condition for stay and under proviso of Section 15 of Consumer Protection Act, 1986 while filing appeal along with interest accrued thereon, if any, be paid to respondent No.1-Sunita Pramod Londhe/org. complainant.

4.      Misc. Appl. No.556/2010 & Appeal No.1016/2010 stands disposed off accordingly.

5.      Copies of the order be furnished to the parties.
