Taken up through video conferencing. 1. Heard learned counsel for the petitioner. Perused the material on record, including inter alia the District Commission’s Order dated 28.05.2014, the State Commission’s impugned Order dated 09.02.2021 and the petition. 2. The dispute relates to repudiation of a mediclaim on the death of the insured. The District Commission allowed the complaint, on contest, and ordered the insurance company (the petitioner herein) to pay the balance sum assured of Rs. 1,29,187/- with simple interest at the rate of 9 % per annum and compensation of Rs. 5,000/- and cost of litigation Rs. 4,000/- to the complainant (the respondent herein). The insurance company appealed before the State Commission. The State Commission re-appraised the evidence, concurred with the District Commission, and dismissed the appeal. As such this petition has been filed against concurrent findings of the two fora below. 3. During the course of the arguments learned counsel requests for a brief interlude to seek instructions. After an interlude learned counsel submits, on instructions, that the insurance co. does not wish to pursue its petition and wants to withdraw it. The submission is recorded. The insurance co. shall be bound by the submission made by its learned counsel on instructions. 4. The revision petition no. 552 of 2021 is dismissed as withdrawn, without the option to file it again before this Commission. 5. The Registry is requested to send a copy each of this Order to all parties in the petition and to the District Commission within three days. The stenographer is requested to upload this Order on the website of this Commission immediately. |
