          In view of the statement of learned counsel for respondent-complainant, impugned order dated 22.01.2016 passed by learned District Consumer Disputes Redressal Forum, Panipat (in short ‘District Forum’) is set aside and complainant is granted liberty to file fresh complaint on the same very cause of action.

2.      However, complainant-respondent may be granted benefit as provided in Judgment of the Hon’ble Supreme Court in Laxmi Engineering Works Versus PSG Industries Institute (1995) 3 SCC 583. The appellants-opposite parties are directed not to disconnect the electricity connection of the complainant subject to deposit of 25% of the disputed amount i.e. Rs.11,21,958/-.

3.      Statutory amount of Rs.25,000/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules.
