[1]     Heard the Complainant.  Perused the complaint and documents attached with the complaint. That primafacie it’s revealed that transaction between the Complainant and the Opponent is regarding refund the money which is given by the Complainant to the Opponent.  No where it is mentioned in the complaint by the Complainant that some amount was given to the Opponent in relation to any goods sold or delivered or agreed to be sold or any service provided or agreed to be provided.

[2]     Complainant also not satisfied to Commission after given opportunity to prove compliance of provision under Section 35 of Consumer Protection Act, 2019.

[3]     Complainant also failed to prove what kind of unfair trade practice as well as deficiency committed  by the Opponent.  Considering the arguments of the Complainant, the Complainant alongwith documents and facts of the complaint, this complaint is not covered  under purview of C.P. Act.  Hence, we passed the following order :-  

                                      //ORDER//

1. The complaint is hereby rejected.
2. No order as to costs.
3. The certified copy of this order be furnished to the Complainant free of costs.
4. The member sets (if any) shall be returned to the Complainant.
