ORDER

Order dt.29/08/1992 The relief claimed by complainant in his complaint is to direct the respondent Landlord, owner of a house occupied by complainant as a tenant, to repair the same and to restrict the latter not to evict him from the leased premises. The respondent has opposed this on the ground that the matter involves adjudication under the KRC Act,1961 and this Forum cannot adjudicate the same. This fact is undisputed. The provision of the Karnataka Rent Control Act,1961 are attracted and this Forum cannot adjudicate the dispute (vide 1972 (1) MLJ 570 ACR 1977 (Kar)160-ACR SC 2117) as there is Seperate Act. It is reprehensible that matter pertaining to be adjudicated in other Forum or Courts are pressed in this Forum under Consumer Protection Act which is purely to protect Consumers as defined under the same deligation of present tyres are to be discouraged by levying heavy cost on a frivolious complaint. Complaint is dismissed. Cost of respondent Rs.300/-. sd/- G.Vamdev President sd/- B.A.Hasanabba Member
