Taken up through video conferencing. 1. Heard learned counsel for the petitioner. Perused the material on record. 2. This petition has been filed against concurrent findings of the two fora below. 3. Further to the Order dated 20.09.2021 learned counsel for the petitioner insurance co. submits that record of the medical examination report of the deceased life assured made by the petitioner insurance co. prior to the issuance of the subject policy along with the papers connected therewith could not be located. 4. During the course of the arguments learned counsel requests for a brief interlude to seek instructions. 5. After an interlude learned counsel submits, on instructions, that the petitioner insurance co. does not wish to pursue its petition. 6. In the wake of the above submission, the revision petition no. 401 of 2021 is rendered infructuous and is dismissed as such. 7. The Registry is requested to send a copy each of this Order to all parties in the revision petition and to their learned counsel within three days. The stenographer is requested to upload this Order on the website of this Commission immediately. |
