MR. JUSTICE AKHTER HUSAIN KHAN, PRESIDENT (ORAL)

Present application has been moved by appellant in appeal No.924/15 Urmila Eye Hospital Vs Sunaina Singh for release of statutory amount deposited in said appeal under Section 15 of the Consumer Protection Act.

We have perused the records of the said appeal. The said appeal has been finally disposed of vide judgment and order dated 16.03.2016 passed by this Commission. Appeal has been allowed. Impugned judgment and order has been set aside.

In view of above amount deposited in appeal by appellant under Section 15 of the Consumer Protection Act shall be refunded to appellant. The District Consumer Forum shall pass appropriate order with regard to amount deposited before District Consumer Forum in compliance of interim order dated 20.05.2015 passed in said appeal in terms of final judgment of appeal dated 16.03.2016.

Application is disposed of accordingly.
