Present:-    None for the appellants.

          This appeal of Punjab National Bank has been filed on 22.12.2021 through Mr. Pancham Sharma, Advocate. Ever since, it has been filed; on many dates fixed subsequently in this appeal; i.e. 07.01.2022, 22.08.2022, 02.09.2022, 03.11.2022, 22.11.2022, 15.05.2023, 12.10.2023 30.11.2023, 19.01.2024 and today also i.e. 28.03.2024; nobody has appeared on behalf of appellant. On few dates i.e. on 19.05.2022, 20.12.2022, 16.03.2023, 17.07.2023 and 11.09.2023, learned proxy counsel has appeared on behalf of Mr. Pancham Sharma, Advocate. Only for once (on 21.07.2022) Mr. Pancham Sharma, Advocate has appeared himself. Today also position is none better. Because of above reason; preliminary hearing in this appeal could not materialize till date. This Commission is satisfied that this appeal cannot be allowed to linger on for indefinite period, only for presence of counsel for the appellant, so that preliminary hearing in appeal should take place. This Commission is also satisfied that because of above reason which are apparent on record; learned counsel for appellant does not have surviving interest towards meaningful prosecution of this appeal. This being so, present appeal stands dismissed in default, for want of prosecution. It is ordered accordingly. File be consigned to record room.
