The basic fact of the case of the complainant is that the complainant Md. Harej Sk purchased one Motor Cycle from the OP No.1 Sumit Kumar Kar bearing no. WB-52BD/7376 for Rs.70,000/- in cash. Having received the purchase money one agreement was

executed for which the OP No.1 paid the EMI of finance company as Pro-OP No.2 Branch Manager Bajaj Finance Limited. OP No.1 collected the NOC and transferred his name to the complainant. The OP No.1 did not pay the EMI of the finance company. Due to non-payment of EMI the finance company forcefully seized the said vehicle on 14.05.2023 from the complainant. The complainant informed the said matter to the OP No.1 and requested him to return the money of Rs.70,000/-. OP No.1 assured the complainant that he would return the said amount of Rs.70,000/- immediately. But the OP No.1 did not pay the said amount despite several requests. The complainant is a helper of a mason. Due to said seizure the complainant is unable to perform his duty for which he has suffered loss of Rs.1,00,000/-. Subsequently, the complainant sent a legal notice through his advocate on 05.02.2024 and 10.02.2024. Despite several requests and receipt of the advocate’s letter the OP did not return the said money. So, the present case is filed. The cause of action arose on 14.05.2023 and on subsequent dates. The complainant , therefore, prayed for an award for Rs.70,000/- towards total money paid together with interest @12% p.a , Rs.1,50,000/- for harassment and loss and damages and litigation cost.
The notice of this case was served upon the OP No.1. On the basis of the order no.3 dated 07.05.2024 the case is decided to be heard ex-parte against OP No.1& Pro-OP No.2.
The complainant in order to substantiate the case proved the following documents:-
Annexure-1:- Is the copy of agreement dated 19.05.2022 between the complainant Md. Harej Sk and OP No.1 Sumit Kumar Kar.
Annexure-2:- Is the copy of insurance of vehicle with the insurer Bajaj Allianz Insurance Company .
Annexure-3:- Is the registration document of the Motor Cycle in the name of Sumit Kumar Kar.
Annexure-4:- Is the Sell Certificate in the name of Sumit Kumar Kar.
Annexure-5:- Is the road challan in the name of Sumit Kumar Kar.
Annexure-6:- Is the reprossessed vehicle inventory list.
Annexure-7:- Is the statement of account of Bajaj finance.

Annexure-8:- Is the letter of advocate dated 05.02.2024 by Makbul Rahaman.
Annexure-9:- Is the another letter of Advocate Makbul Rahaman dated 10.02.2024.
Annexure-10:- Is the copy of Adhar Card in the name of the complainant Md. Harej Sk.
The complainant duly adduced evidence by filing the evidence on affidavit. The complainant also proved the documents in course of trial. The entire oral and documentary evidence of the complainant stands unchallenged and undiscarded in as much as the case is heard ex-parte against both the OP NO.1 & Pro-OP No.2. The OP No.1 & Pro-OP NO.2 could not disprove the case of the complainant by any cogent evidence or any document in favour of the opposite parties .
Therefore the case of the complainant stands unchallenged and undiscarded.
Accordingly, in the backdrop of the aforesaid discussion and observation made hereinabove it is held that the complainant duly proved the case against both the opposite parties ex-parte.
Accordingly, the complaint case succeeds ex-parte against both the OP No.1 & Pro-OP No.2 with cost.

It is
Ordered
that the complaint case no.CC/25/2024 be and the same is allowed ex-parte against both the OP No.1 & Pro-OP No.2 with cost of Rs.5,000/- (Rupees five thousand). The complainant Md. Harej Sk do get an award against the OP No.1 Sumit Kumar Kar for a sum of Rs.70,000/- (Rupees seventy thousand) towards the actual money paid together with interest @ 12% p.a from 19.05.2022, Rs.30,000/- (Rupees thirty thousand ) towards harassment and mental pain and agony and

Rs.5,000/- towards litigation cost. The OP NO.1 is directed to pay Rs.1,05,000/- (Rupees one lakh five thousand) to the complainant together with interest as above within 30 days from the date of passing the final order failing which the entire award money shall carry an interest @8% p.a from the date of passing the final order till the date of its realisation.
All Interim Applications (I.A) stand disposed of accordingly.

Let a copy of this final order be supplied to both the parties at free of costs.
