The complainant is present in person by filing hazira.
No step is taken by the O.P. in spite of service of notice.
In view of the previous conditional order dated: 05-09-2022 the case is taken up for Ex-Parte hearing.
The Complainant purchased a two wheeler TDS JUPITAR ZX from the O.P. on 24-10-2019 for Rs.78,455/- bearing Engine No.PG4KK1901963 and Chasis No.MD626EG42K1KO3765. The O.P. duly received the said amount including (Registration Charge + Insurance Premium) of Rs.17,523/- and issued Road Challan but till now the Complainant has not received Registration Certificate and Insurance Policy Certificate of the said two wheeler for which he has now approached this Commission for appropriate relief.
After condoning the delay the case was admitted and notice was issued upon the O.P. but he has not turned up in spite of repeated notices served upon him.

It is the duty of the Dealer to arrange for Registration Certificate and Insurance Policy Certificate in favour of the buyer of the Vehicle at the appropriate stage and time but the O.P. has failed to discharge his duty as Dealer putting the Complainant in trouble for not plying the Two Wheeler on the roads in absence of all those relevant papers. In support of the claim the Complainant has produced the Money Receipt and the Road Challan and other relevant papers. The Complainant is entitled to get the relief as prayed for.
Hence, it is ordered……………
That the case is allowed Ex-Parte against the O.P.
O.P. is directed to arrange and make over the Registration Certificate and Insurance Policy Certificae of the above mentioned Two Wheeler in favour of the Complainant within a month failing which he has to pay the entire value of the Vehicle i.e. Rs. 78,455/- as compensation and on such payment of compensation if any the Complainant will hand over the said Two Wheeler to the O.P. on proper receipt and acknowledgement.
Let a copy of this order be given to the parties free of cost. The complainant is directed to serve the Final Order upon the O.P. by Speed Post for early compliance.
