The complainant’s case is that he joined the 10th day monthly kuri vide statement No.5. The complainant bid the kuri in auction on 10.10.07 and the director board of the respondent company decided to pay the amount. But the amount of Rs.42,870/- was given to him only on 24.3.08. However no interest was given from 31.12.07 to 24.3.08. The complainant sent a lawyer notice on 27.3.2008 demanding to pay the interest due to him. But there was no remedy. Hence the complaint.
2. The respondent called absent and set exparte.
3. The complainant filed affidavit and the documents produced by him are marked as Ext. P1 and P2.
4. The complainant’s case is that he bid the kuri in auction on 10.10.07 and the director board meeting held on 31.12.07 decided to pay the kuri amount to the complainant. But the amount of Rs.42,870/- was given to him on 24.3.08. But no interest for the period from 31.12.07 to 24.3.08 was given to him. The complainant is entitled to get interest for the amount of Rs.42,870/- from 31.12.07 to 24.3.08.
5. There is no evidence to the contrary.

In the result, the complaint is allowed and the respondent is directed to pay interest at the rate of 9% per annum for the amount of Rs.Rs.42,870/- from the date of last payment till realization with costs Rs.500/- (Rupees five hundred only) within two months from the date of receipt of copy of this order.
