The Complainant/Dhr. files hazira through Advocate.

The case is fixed for passing necessary order.
It appears from the record that the Complainant/Dhr. obtained an order on contest passed by this Commission on 04/09/2013 in C.C. No.10/2012 with the direction to get refund of Rs.5,14,200/- from the original O.P. No.1 & O.P. No.2 (since deceased) as consideration money with Rs.53,122/- as Stamp Duties, Commission fees etc. with further direction to get Rs.50,000/- as compensation from the original O.P.s. On Appeal No.being F.A./1078/2013 the said order was affirmed by the State Commission, West Bengal by Judgement dated: 04/03/2016 and the Revision Petition No. being 1324 of 2016 at the instance of O.P. No.1 was dismissed for non-prosecution by Order dated: 16/05/2019 of Hon’ble NCDRC, New Delhi. In the mean time the Complainant/Dhr. put the Final order dated: 04/09/2013 into execution before this Commission and during the pendency of this Execution case original O.P. No.2/Jdr. expired and substituted by her ultimate legal heir Smt. Radha Rani Singha as above.

Now both the Decree Holder, Nimai Chandra Akuli and the Surviving Judgement Debtors namely Sri Sukdeb Roy and said Smt. Radha Rani Singha have come to an amicable settlement reduced into writing signed by both the parties and their respective lawyers filed before this Commission agreeing thereby to satisfy the compliance of the Final Order dated: 04/09/2013 by way of payment of Rs.6,36,322/- to the said Decree Holder by the O.P./Jdr.s jointly and severally and to get Deed of Conveyance executed and registered at the instance of Complainant / Decree Holder in respect of the property in question in favour of the above mentioned O.P./Judgement Debtors within six(6) months from this date.
The settlement as above is found to be valid and legal and is accordingly accepted.
The Execution case is therefore disposed of on full and final satisfaction in terms of the settlement as above with liberty given to the parties to approach this Commission for enforcement of the settlement in case of any disobedience thereof.
Both parties be supplied copy of this Judgement free of cost.
