   JUDGMENT

JUSTICE SHRI. K.R. UDAYABHANU:PRESIDENT

The appellants are the opposite parties in CC.205/2009 in the file of CDRF, Thiruvananthapuram.  The appellants are under orders to pay a sum of Rs.89,076/- and Rs.5000/- as compensation and Rs.1500/- as costs.

The matter relates to the defective laptop purchased by the complainant from the opposite parties for a sum of Rs.98,000/-.  The opposite parties/appellants remained exparte before the Forum.  It is the case of the appellant that the managing partner was abroad at the time notice was received from the Forum.  The reason mentioned is hardly sufficient to justify the absence of the opposite party before the Forum.   All the same, in view of the fact the matter has been disposed of uncontested the appeal is allowed on payment of cost of Rs.7500/- to the complainant. On deposit of the above sum, the Forum will permit the opposite parties to file version and contest the case.  The case stands posted before the Forum on 14/12/2010.
