This case record is taken up for consideration in the matter of passing order of this MA case which is initiated by OP-1 for expunging the name of the OP-1 from this case.

This matter has been contested by OP on this MA case who is the complainant of CC-83/2023.  And written objection has also been filed by the Op of the MA case against the prayer of expunging the name of Mr. Sachchidananda Rai.

The argument highlighted by ld. advocates of both sides has been heard in full.  Considered submission.

Perused the material on this case record.

On close examination of the material of case record of MA case no.72/2023 as well as the case record of CC-83/2023, this District Commission finds that the OP-1 is  not a necessary party in this case and he has been impleaded in this case without any justification.  For the reason the prayer of the OP-1 for expunging his names from CC-83/2023 can be allowed.

In the result, it is accordingly,

that this MA case -72/2023 be and the same is allowed on contest.  Let the name of the OP-1 be expunged from the CC-83/2023.

In the light of the observation made above this MA case is disposed of.

No order is passed as to cost.
