Complaint in brief:-


 

Complainant availed loan of Rs. 1 lakh from opposite party bank in the year 2001. He could not repay any amount towards the loan. Amount was doubled to Rs. 2 lakh in the year 2008. Loan was renewed in the year 2008 dividing the previous loan amount in to three loans for Rs. 50,000/-, 1 lakh and Rs. 50,000/- respectively. Complainant could not repay he said loan also. Opposite party issued notice stating recovery proceedings will be initiated. Complainant pledging his wifes ornaments and availing loan repaid the entire amount on 31/05/2012. Meanwhile complainant received reply letter issued by the Honble Chief Minister directing the complainant to send the complaint to the Registrar of the Co-operative Societies, Thiruvananthapuram. Complainant sent the complaint for which Registrar issued letter to directing provide maximum relief to the complainant. But opposite party has not acted as per the letter. Hence complainant claim refund of the already deposited amount together with compensation and cost.


 

Complaint was posted for hearing on admission. On two occassions complainant was not present and hence taken for orders.


 

On going through the facts of the case we find that the complainant has no case that opposite party collected a wrong/excess loan amount. Complainant has admitted that he has not repaid any thing towards the loan amount. We do not find any Consumer disputes in the matter as per the provisions of Consumer Protection Act.

Hence we find that the complaint is not maintainable before the forum.
