Matter is recalled at 3.45 p.m. but nobody for the appellant is turned up. Adv. Mr. Nagare for the respondent is present. Therefore, the appeal deserves to be dismissed in default.


 

Moreover, there is also delay condonation application. On perusal of delay condonation application, it reveals that there was inordinate delay of more than 70 days, but no proper explanation appears to have been given for condonation of such inordinate delay. Therefore, on this ground also, the delay condonation application as well as appeal deserves to be dismissed.  Any how, as the appellant as well as his counsel are absent, the appeal is dismissed in default. No order as to cost.
