Misc Case No. 456 of 2014

      This relates to a petition for condonation of delay. There is delay of 86 days in preferring the appeal.

       Heard learned counsel for parties on the point of limitation.

       Learned counsel for the petitioners/appellants submits that after receiving copy of the impugned order dated 20/08/2013 on 09/12/2013, the learned counsel appearing before the District Forum forwarded it with his opinion on the same date to the petitoner’s office at office at Kolkata. After receiving the same from the dealing advocate engaged in District Forum the Kolkata Office sought for somr clarification from the said advocate and after receiving the same took administrative decision on 20/03/2013 to file an appeal before this Commission. the record was forwarded to the counsel engaged in this Commission on 26/03/2014 and the appeal was filed on 04/04/2014. So, learned counsel for the petitioners/appellants submits that the delay caused was not intentional.

     The maximum period of delay was caused in th eoffice at Kolkata because of negligence of the said office, which has not been properly explained. We find no sufficient causeto condone the delay. So, the Misc. Case for condonation of delay is dismised and consequently, First Appeal no. 201 of 2014 stands dismissed.

     Records received from the District Forum, Angul be sent back forthwith.
