ORDER

This appeal is directed against the judgment and order dated 15.06.2010 passed by the District Forum, Udhamsingh Nagar, whereby the direction was given to the opposite parties to take decision on the complainant’s claim within a month from the date of order and to pay claim amount after three months from the presentation of the claim alongwith simple interest @ 7% till the date of actual payment.

The respondent No. 1-complainant has moved an application before this Commission wherein it is stated that the claim amount has been paid by the opposite party No. 2-insurance company, therefore, the appeal be dismissed on the ground that she has received the amount through District Forum from the insurance company in compliance of the order of the District Forum. 

On the last date, the learned counsel for the insurance company-respondent No. 2 has sought time for seeking instructions regarding the application filed by the respondent No. 1-Sh. Sudama Lal Agarwal that the amount has been paid to the respondent No. 1- Sh. Sudama Lal Agarwal or not.

Therefore, in view of the application moved by the respondent No. 1-complainant, the appeal is liable to be dismissed, as infructuous.

Accordingly, the appeal is dismissed, as infructuous.
