This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. When the time of admission as there was a question with regard to the maintainability of the complaint, this case was posted for admission hearing from 02/12/2020 onwards. For getting a clarification regarding the maintainability of the compliant before this Commission, this Commission issued notice to the complainant to appear before this Commission for the said purpose. Though the notice issued to the complainant was served on him, the complainant has failed to appear on the date fixed for his appearance or on the subsequent dates. Inspite of accepting the notice and getting informed over phone from this Commission the complainant failed to appear before this Commission till this date for giving a clarification with regard to the maintainability of this complaint. In view of the continuous absence of the complainant we find that this is a fit case to be dismissed.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
