ORDER

Complaint is partly allowed. 1.The Complainant is entitled to recieve possession of the vechicle from the O.P. and the O.P. shall deliver immediate possession to the complainant subject to following conditions. 2.The complainant shall deposit all instalments which are due upto the months of june 2004 without any interest or default charges or charges of any other type and the O.P. is directed to return all cheques issued by the complainant upto June 2004. The O.P.s are further directed to recover the balance of the loan as per schedule in instalments, keeping the repayment period intact. The O.P.s are entitled to recover cheque dishonour charges of Rs.200/- and additional interest at 2% p.m. on arrears from 15.09.2003 (the date on which the complainant's Bank has imposed cheque return charges) to 28.09.2003 amounting to Rs.17/-. Both the amounts shall be paid by the complainant along with the arrears of instalment before taking delivery of his vehicle. Except the above the O.P.s are not entitled to recover any other charges from complainant. The O.P.s are directed to pay the complainant Rs.4000/- as compensation for the deficiency in service within two months from the date of this order failing which the amount shall carry interest at the rate of 9% p.a. Send certified copies of this judgement and order to both O.P.s by RPAD and to the complainant under COP.
