The SHO of P.S. Sadasivpet submitted stating that the JDR could not be traced and returned NBW unexecuted. The JDR is present and filed a memo starting that the JDR is harassing him with the help of some other persons. But said allegation cannot be taken in to consideration to decide the instant claim. The JDR is at liberty to take appropriate action against said person in accordance with LAW if he is so advised. It is to be seen that as per available record only a sum of Rs.6000/- is lying  to the credit of this case. The JDR did not pay back by claim amount. The refer in the circumstance we hold that the offence U/S 27 of the C.P. Act  1986 is duly proved and as such the JDR is can the  vide separate order for the said offence U/S 255(2) Cr.PC and sentenced to undergo simple imprisonment      for a period of two month.
