Today is the date fixed for ex parte argument and filing BNA.

It appears from the case record that this case record was put up vide order no. 15 dt. 17.10.2023 and one M.A. case no. 85 of 2023 is pending. However Ld. Advocates for the complainant and op no. 1 ……. appear today. Both partied intend to take part in the hearing of the said M.A. case no. 85 of 2023. The application for M.A. case no. 85 of 2023 is placed for hearing today.

Ld. Advocate for petitioner/ op no. 1 and ld. Advocate for op/ complainant are present. Petitioner/ op no. 1 filed the said M.A. case for setting aside the order of ex parte hearing of the instant complaint case no. 09 of 2022.

Ld. Advocate for the complainant has given his consent verbally to allow the said application filed by op no. 1 / petitioner in the said M.A. case for setting aside ex parte order, but with cost, although the Advocate for op/ complainant endorsed his “strong objection” on the put up application filed on 17.10.2023 in the said M.A. case.

Under this circumstances heard the M.A. case, considered submission.

Set aside the ex parte order, subject to payment of cost of Rs. 1000/- only which is to be paid to the Consumer Legal Aid Account, DCDRC, Hooghly by the op no. 1/ petitioner.

Accordingly the M.A. case no. 85 of 2023 is disposed of with cost of Rs. 1000/- .
