The complainant has filed the complaint before this Forum against the O.ps for Redressal of her grievance under the Consumer Protection Act(1986) in terms of the prayer made in complaint petition.
As per the terms and conditions of the said cumulative deposit, the complainant shall renew the deposit on the date of maturity and in the event if the complainant fails to renew the deposit after the date of maturity, the O.Ps 2 & 3 shall immediately renew the fix deposit policy without prior approval of complainant.
After the date of maturity the complainant could not be able to renew the aforesaid fix deposit for 4 to 5 years after 12.12.2007 since she was ill and bedridden. After recovery, the complainant approached the O.Ps for encashment of the fix deposit and released the deposited amount but the O.Ps did not respond so the complainant issued a notice on 23.05.2015 giving an ultimatum to O.Ps to pay the aforesaid money under the fixed deposit scheme. Though the O.Ps 2 & 3 have received the notice but they preferred to remain silent. Copy of notice (Annexure-2).
Finding no other way, the complainant took shelter of this Hon’ble Forum. She has prayed for direction to the O.Ps to pay the maturity value under the cumulative fixed deposit scheme with interest and a sum of Rs.1,00,000/- as compensation towards mental agony and harassment along with cost of litigation worth Rs.10,000/-.
Basing on the facts and circumstances as stated above, the O.Ps are found deficient in rendering service which amounts to unfair trade practice by the O.Ps.
EXPARTE ORDER
The O.Ps are directed to pay the maturity value of Rs.1,88,526/- only along with 10% interest per annum from the date of maturity i.e. from 12.12.2007 till date of final payment. The O.Ps will also pay a further a sum of Rs.10,000/- towards cost of litigation to the complainant within 45 days from the date of receipt of copy of this order.
