JUDGMENT

Per Sri Sushil Kumar,  Member-   This appeal has been directed against the judgment and order dated 19.9.2012 passed by the Ld. District Commission, Sant Kabir Nagar in complaint case no.50 of 2011, Shri Subhash Chandra vs. Executive Engineer, Poorvanchal Vidyut Vitran Nigam Ltd. and another,  whereby the ld. District Commission by allowing the complaint directed the opposite party/appellant not to raise any bill against the connection no.657010 on the ground that the electricity department issuing the electricity bill against the provisions of free supply to the consumer under Kutir Jyoti Plan sponsored by the Government of Uttar Pradesh.

Ld. counsel for the appellant submits that this plan was discontinued by the State Government, therefore, the electricity department has changed the electricity connection in LMV-1 plan and issued the bills accordingly but no notice has been given by the appellant to the respondent/ complainant before converting the electricity connection from free supply plan to LMV-I. Therefore, the judgment and order passed by the ld. District Consumer Commission need not to be interfered. The appeal deserves to be dismissed. 

ORDER

          Appeal is dismissed. The judgment and order dated 19.9.2012 passed by the Ld. District Commission, Sant Kabir Nagar in complaint case no.50 of 2011 is confirmed.

If any amount is deposited by the appellant at the time of filing of this appeal under section 15 of the Consumer Protection Act, 1986, may be remitted to the ld. District Consumer Forum concerned for satisfying the decree as per rules alongwith accrued interest upto date.

The stenographer is requested to upload this order on the Website of this Commission today itself. 

          Certified copy of this judgment be provided to the parties as per rules.
