          Case taken up today on an application filed on behalf of respondent for recall of order dated 23.2.2012, passed by this Commission to the extent, it imposes cost of Rs.2,500/- upon the respondent, passed by this Commission.

Heard.

          The order of which recall is sought, read as under ;

“Proxy counsel for the respondent states that arguing counsel for respondent Ms.Shobha is busy in Supreme Court.

Date is sought.

On the last date of hearing, when the matter was listed for final hearing, none was present on behalf of the respondent.

In the interest of justice, last opportunity is given to the respondent to argue the matter subject to payment of Rs.2,500/- as adjournment costs.

Costs of Rs.2,500/- be deposited by way of cross cheque in the name of Consumer Legal Aid Account of this Commission, within four weeks.

List on 9.5.2012 for final hearing.”

          After going through the above order, we find that there is no infirmity or ambiguity of the same.  The present application has been filed just not to pay the adjournment cost and to waste the time of this Commission.  Accordingly, the present application is hereby dismissed with cost of Rs.2,500/-.  Respondent is directed to deposit cost of Rs.2,500/- by way of demand draft in the Consumer Legal Aid Account of this Commission, within four weeks.

          List the matter on 9.5.2012 for final hearing, the date already fixed.
