Complainant files  hajira.  O.P. No.1 & 2 files hajira along with some documents as per the firisti.  Fixed for hearing of the petition dated 20-01-2017 filed by the Complainant.  Let the petition be registered as Misc. Case No.21 of 2018.

The Misc. Case is taken up for hearing.

Ld. Lawyer for the Complainants stated in the petition that original Savings Account Pass Book bearing No.684511, Original Account opening form and some other important documents are in the custody and possession of the O.Ps. and the production of the same before this Forum are necessary for the proper adjudication of the case and accordingly prays for a direction upon the O.Ps. for the same.

Ld. Lawyer for the O.P. stated that a duplicate Pass Book has been issued and delivered to the complainants as per their demands and the Complainant received the same with satisfaction.  The O.P. also stated that as per the postal rules in case relating to savings bank frauds original pass book should be treated as cancelled and sent to the central organization and so it is not possible to deliver the original pass book to the Complainant.  The O.P. submitted Xerox copy of letter issued by the Complainant stating his satisfaction with the return of pass book and one Xerox copy of postal rule related to this case.

We have verified the documents.  It is clear that the Complainant received the Pass Book in question with full satisfaction.  It is also clear from the postal rule that the original pass book should be in the custody of central organization and a duplicate pass book may be issued to the depositor.  The Ld. Lawyer for the Complainant has no objection regarding the matter.  However, since the Complainant himself is not present today we have decided to fix another day for the appearance of the Complainant for reporting compliance.

Thus the Misc. Case no.21 of 2018 be and the same is disposed of.
