Final Order / Judgement

MR BIBEKANANDA DAS, MEMBER:-

                 Complainant has filed the C.C.Case No. 206/2023 U/s-35 of C.P.Act, 2019 seeking  the following relief:

            “Hon’ble Commission may direct the Ops to refund the money order amount alongwith compensation in  favour of the Complainant”.

            Heard the Ld. Counsel for the Ops and Complainant himself. Perused the entire case records and so also documents available on record and also gone through the complaint petition & written version filed by the Ops.

            The case of the Complainant is that he has send two EMOs (electronic Money Order) amounting Rs. 1806/- & Rs. 25/- vide PNR No. 085010982966000010 & 085010982966832010 respectively to SOIL CONSERVATION OFFICE, Kendrapara to get some RTI information. But unfortunately the above said amount has not been received by the said Office till 09.02.2024 which is clearly evident from the written version filed by Op No.4.

            It is very much pertinent to mention here that the OP No. 1 to 3 have filed their written version on dt. 10.09.2024, wherein they have clearly admitted in Para 4 & 5 of their written version that the money order was sent from Patkura S.O. on dt. 26.10.2023 but it has been received by Op No.4 on dt. 21.12.2023, it means near about two (2) months delay has occurred in receiving the above said amount, which  clearly show that the Op No. 1 to 3 have committed gross negligence & deficiency in service as has been defined U/s-2(42) of C.P.Act, 2019. Hence the order.                                                  

O R D E R

            We therefore direct to Op No. 1 to 3 to refund Rs. 1831/- to the Complainant  alongwith Rs. 2,000/- towards the compensation for mental agony and harassment undergone by the Complainant during these period and so also the Op No.1 to 3 shall pay Rs. 1000/- towards litigation cost to the Complainant  within a period of 45 days from the date of receipt of this order, failing which the Op No.1 to 3 shall be liable for execution proceeding under the C.P.Act, 2019.

            With the aforesaid observation & direction, the C.C.Case No. 206/2023 is allowed and accordingly disposed off. Issue extract of the order to the parties for compliance.    

              Pronounced in the open Commission, on this the 30th day of September, 2024.
