FINAL ORDER

            This case has been filed by the complainant u/s 12 of C. P. Act, 1986 praying for payment of pension for March 2016 in total Rs.23,411/-.

            Today is fixed for filing show-cause petition by the complainant, in default; the case shall be dismissed for non-prosecution. No hazira has been filed by the complainant.

The OP files hazira and is present at the time of hearing.

From the case record it appears that the complainant takes no steps after the case was admitted on 20.06.2016 whereas the OP filed written version on 22.7.16.

            From the order No.8 dt. 20.01.2017 it appears that the complainant was showcaused as to why the case would not be dismissed for non-prosecution but the complainant did not submit any show-cause reply. In our opinion, the complainant is not interested to proceed with this case and he has been dragging the case day after day since 26.04.2016. As a result, the case, in our considered view, should be dismissed.

            Hence,

                                                                 Ordered

that the Consumer Complaint No. 61/2016 be and the same is hereby dismissed for non-prosecution. There will be no order as to cost. 

 

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
