Final Order / Judgement

 

1.               The grievance of the complainant is that he is a consumer of the Opposite Parties vide     consumer No: 713101010565 and he was regularly paying the Electricity bills of the O.Ps. But surprisingly on 19.1.2015  he has received an exaggerated bill demanding a sum of Rs 20,147/- for the month of December, 2014 which is extremely high in compare to previous consumptions and such demand by the O.Ps is without any reason. Further case of the complainant is that he requested the Ops to inspect the meter regularly and issue correct bill with supply of standard voltage under the provision of OERC. The issue of  exaggeration bill  has caused him financial loss, mental agony and physical harassment.  Hence he has approached this forum for the protection and relief as per her prayer.

2.               The O.Ps in their counter submitted that due to the  shortage of meter reader complainant had received the provisional bills thereafter he  got the bill  of  Rs.20,147/- on actual basis. Previsousely the complainant was received the bills for 115 unit due to defective meter. It is further contended that as per OERC rule the disputewd bills will be revised considering the average consumption of three months, As there is  no deficiency of service, damage or harassment in any way caused to the complainant at any time he preayed for dismissal of complaint case.

      3.               From the written version submitted by the O.Ps, it is crystal clear that violating the OERC guideline  they were charged E.C Bills on provisional basis and thereafter they charged excess amount . Further they are assuring revision  after fixing a new meter definitely caused harassment to the poor consumer and finally finding no other alternative he approached this forum by spending his valuable time and money for redressal of his grievances.

      4.                In the result, the complaint of the complainant is fit to be allowed in part and complainant is entitled to an appropriate order in terms of Section 14 of the C.P. Act. Hence, we proceed to pass the following order. Hence it is ORDERED :

                                                                                       ORDER

The bill of December, 2014 issued against the complainant be quashed. The opposite parties are directed to issue proper bill after fixing a new and perfect meter, after observing three months consumptions, fix average monthly consumption for entire disputed period, deduct the total payments made by the complainant from the total amounts and the complainant is to pay the said revised amount after its receipt on installment basis. It is also directed the Opposite Parties to supply 230 voltage (+6 or -6) or pay Rs. 200/- as compensation under the provision of OERC. The Forum also ordered the O.Ps to pay Rs 5,000/ - to the complainant as compensation for mental agony and Rs.2,000/- as cost of the case within 30 days from the date of the order.         

The complaint petition allowed. 

 Copy of the order be communicated to the Parties as per rules
