  1. In the present complaint, counsel for the complainant has averred thatcomplainant earlier applied for first time of 20.01.2022 for electric connection in the category of NRS and said file was marked by OP on 20.01.2022 but no action was taken by Op after the said marking and thereafter, said file returned to complainant by officials of OP namely Gurwinder Singh JE.Complainant surprised to know that the photo of the complainant, Jamabandi self-declaration and Adhar card etc were removed from said file.  Again the complainant approached and requested the OP and second file was also prepared and submitted before the OP and second file was also prepared and submitted before the OP.  That file is also lying with the OP and thereafter third file was also prepared on the asking of OP but no action regarding supply of electric connection was taken by OP.  On third file the poles were installed by OP for said connection but connection was not given and when the complainant approached and requested to OP they said the file of complainant has been misplaced and forth one be prepared.  On direction of OP the fourth file was prepared and submitted on 29.11.2022 with OP.  Said file is lying in office of OP at present but no connection is given to complainant till now by OP.  Two poles for supply of electricity were installed by OP from Village Khawaspura and it was told to complainant that expenses of said installation of poles would be incurred by complainant.  At that time, Ravinder Dass JE and on another official of OP were present there.  Earlier on 23.11.2022 complainant was told by OP to deposit Rs.3700/- as security but after depositing the said amount it was also told by OP that the receipt of the same could not be issued later on 02.12.2022.  Surprisingly on 01.12.2022, some officials of OP Ravinder DassJE and Ravinder Kumar JE suddenly visited the house of complainant but complainant was not present at Village Malakpur.  It was told by the wife of complainant namely Kamaljit Kaur and daughter Jagdip Kaur that some official of OP have come in their house and they compelled the said family members of complainant to receive back said security of Rs.3700/- as well as one notice but on asking of the complainant on telephone said family member of complainant refused to take back the money and received said alleged notice.  Thereafter, said officials of OP had thrown said money of Rs.3700/- on a cot which was lying in court yard of house of complainant.  Said notice as well as said money were clicked by family of complainant.  Op has miserably failed to explain any reason that why the said electric connection is not given to complainant.  Lastly, prayer has been made that direction to OP to provide electric connection of NRS category to the complainant at Village Malakpur Tehsil and District Rupnagar.

Upon notice, OPhas appeared through counsel and contested the complaint by submitted that complainant is not maintainable; as the complainant has self-installed two electric poles without any permission, authorization and instructions from answering OP.  Moreover, OP has also written a letter No.1788 dated 01.12.2022 to complainant regarding illegal installation of two electric poles in land without depositing any security, authorization, instruction and permission of OP.  Complainant has thereafter no replied the same even than the answering OP has again written letter on 09.01.2023 to complainant vide letter No.25/09.01.2023 and same manner he has not replied the said letter.  The complainant has applied a connection in his name through A&A form dated 29.11.2022 for NRS connection, but the complainant has not visited to OP again in this regard and when above noted two letters written to complainant for such act and conduct than the complainant has falsely and malafidely filed the complaint against OP.  Even some of the residents of village Malakpur have written letter dated 28.11.2022 to answering OP regarding not to install wires and poles of complainant to which are passing their fields rather than passage near by they have also  mentioned regarding a court case pending before Hon’ble High Court vide application dated 02.12.2022; complainant has not approached to this Commission with clean hands. On merits, it is submitted that complainant has applied a connection through A&A form dated 29.11.2022 for NRS connection but complainant has not visited to OP again in this regard when said two letters written to complainant for his act and conduct.  Other averments of complaint are denied and prayed for dismissal of complainant with costs.
  3. In order to prove their respective versions, both the parties produced on the file their respective documents.
  4. We have heard learned the parties with their valuable assistance and have also gone through the record carefully.
  5. The complainant has produced copies of documents, from which it reveal that the complainant has applied for electric connection.  After going through version, evidence on record of the parties, it transpired that complainant has applied for electric connection, but the complainant has failed to deposit requisite fee and produce the record qua the same before this Commission. 
  6. As a sequel of above discussion, complaint before this Commission is disposed of with the direction that OP be release the electric connection in dispute, on receipt of requisite fee and other formalities, if any, from complainant.
  7. Entire compliance of above said be made by parties immediately from the date of receipt of copy of this order.
  8. Copies of the order be sent to the parties, as permissible, under the rules.
  9. File be indexed and consigned to record room.
