Heard learned counsel for the petitioner. Petitioner filed complaint before the District Forum for quashing bill raised by the opposite party. The District Forum dismissed the complaint. On appeal, the State Commission dismissed the complaint. Perusal of record reveals that penalty was raised as electric meter of the complainant was found burnt and supply was direct, as per the checking report dated 01.03.2005. As this matter pertains to theft of electricity, in the light of judgment passed by the Honle Apex Court in U.P Power Corporation Ltd. & Ors. Vs. Anis Ahmed case, complaint was not maintainable before the District Forum. In such circumstances, complaint being not maintainable before the District Forum, revision petition is dismissed with liberty to the petitioner to approach to the appropriate authority under the Indian Electricity Act for redressal of his grievance.
