SRI.K.T.SIDHIQ, PRESIDENT

            The complainant prays for an order cancelling the bills dated 5-11-08 for Rs.404/-and bill dated 5-1-09 for Rs.404/- on the ground that he was not having the telephone (WLL) connection during that period.  According to him he surrendered his WLL telephone connection 29-8-08 since the WLL telephone provided to him was having recurring defects.

2.            Opposite party filed version and stated that the bill dated 5-11-08 for Rs.404/-is already cancelled and the bill dated 5-1-09 for Rs.404/- has served subsequent to the filing of the case.

3.            Complainant examined as PW1 and Exts A1 to A3 marked.  Both sides heard and the documents proved.

4.         During evidence the complainant submitted that she had received new land line connection in January 2009 and hence she confined her case against the bill dated 5-1-09 for Rs.404/-.

5.         Issuing telephone bills to a person who doesn’t possess a telephone connection is a deficiency in service and it is an unscrupulous exploitation of consumer.

            Hence the bill dated 05-01-09 for Rs.404/- issued by opposite party to complainant is hereby cancelled.  In the circumstances there is no order as to costs.
