F I N A L O R D E R
1.Meghdhan Deb here-in-after called the 'Complainant' filed this complaint alleging that he along with his wife went to the store of the O.P. at Agartala on 04.06.2023 and purchased cloths for Rs.4577/-.
The Debit Card of the wife was given to the Sales Counter for payment but Rs.4577/- was debited twice from the Bank Account of his wife. Being enquired staff of the O.P. replied that the excess amount of Rs.4577/- will be refunded back within 4 days. But after 4 working days such amount was not refunded. As such the complainant sent a mail to the Customer Care of the O.P. but ultimately nothing has been done.
1.2Hence, this complaint.
2.Summon was issued upon the O.P. but the O.P. failed to appear and contest the case. As such vide Order dated 18.08.2023 the case has been proceeding exparte against the O.P.
3.Hearing argument and on perusal of the Bank Account we find that on 04.06.2023 the amount of Rs.4577/- was deducted twice from the Bank Account number ending with 5813 and transferred to the Account of the O.P. Also perused the Tax Invoice of the O.P. Further by not contesting the case the O.P has admitted the case of the complainant. As such we have no hesitation to conclude that the Sales Counter of the O.P. debited the amount of Rs.4577/- twice which they are liable to refund. As such it is illegal trade practice as well as deficiency of service. However, in the evidence on affidavit the Complainant stated that after receiving the notice the O.P. has refunded the amount of Rs.4577/-.
4.In the result, it is ordered that the O.P. shall pay a sum of Rs.10,000/- as compensation which is inclusive of litigation cost.
5.The case stands disposed off.
6.Supply 2 copies of this order to the complainant. The complainant shall communicate one copy of this order to the O.P. for compliance.
