ORDER

The complaint is allowed. The 1st opposite party from whom the complainant has purchased the Television set shall replace the set with a new one or refund the sum of Rs.4,175/- together with interest at the rate of 10% p.a. from the date of this order to him. He further pay a sum of Rs.250/- towards the cost of these proceedings. This order shall be complied with within 45 days from the date of its receipt by the o.p. failing which, penal action as contemplated under section 27 of the consumers protection Act 1986, shall be initiated against him, on a petition made by the complainant in this behalf.
