17-09-14 – The reasons for delay in disposal of this appeal can be seen from the ordersheet.

1.       Heard learned counsel appearing for the appellant on the point of limitation.

On being satisfied with the grounds, the delay of about 18 days in filing this appeal is condoned.   

2.       Inspite of service of notice, nobody appeared on behalf of the respondents. 

Heard learned counsel for the appellant on merits. He assailed the impugned judgment and submitted that the operation, was done without pathological test like, Blood Sugar, Homoglobin, Urine test, B. P.  Test etc. and therefore the respondents were negligent in the treatment of the cataract operation of the complainant resulting in loss of his vision in his right eye. 

3.       The learned Lower Forum, after considering the respective cases of the parties and the materials brought on record by them interalia held that the complainant has failed to establish his case, that the Doctor had not adopted proper procedure in doing surgery; and that the admission form, the Clinical history sheet, treatment card, clinical note sheet investigation card and discharge ticket of the Bokaro General Hospital with respect of the treatment of the complainant does not suggest any negligence on the part of the treating Doctor.  According to the respondents all the investigations and tests necessary for the operation were done.

4.       After hearing learned counsel for the appellant and going through the records, in our opinion, no grounds are made out for interference with the impugned judgment.

          In the result, the complaint petition and this appeal is dismissed.   Issue free copy of this order to all concerned for information and needful.
