Notice on delay condonation application was issued.  From the Roznama dated 07/06/2011, it appears that Mr.L.K.Jadhav-Advocate for the non applicant/respondent present but today he is absent.  Mr.Manoj Gadkari-Advocate for the applicant/appellant, present.

In these circumstances, we prefer to hear the applicant /appellant on delay condonation application.  There is delay of six months in filing the appeal.  Only reason given is that after receipt of certified copy, advocate for the appellant could not prepare and file appeal due to his personal difficulties.  But the name of the lawyer is not mentioned. Reason given is quite vague, not at all satisfactory, much less to explain such an inordinate delay.  We hold accordingly and pass the following order:-

                                      ORDER

Misc.application no.MA/10/491 for condonation of delay stands rejected.

In the result, appeal does not survive for consideration.

Copies of the order be furnished to the parties.
