This is a case for Electric Reconnection and compensation.
The complainant’s case is that the complainant is the resident of Pataspur having Electric connection No. 161/D/DTP at his residence. The Electric connection was disconnected in the month of June, 2004 by the Elec. Deptt. At the request of the petitioner as out dated live wires of L.T. line between two electric posts were hanging. Thereafter, time and again the 1.09.2004 to restore the Electric supply to the petitioner’s premises. Having no relief the petitioner lodged a complaint to the Chairman, Grievance Redressal Forum of the Elec. Deptt. Who directed the OP to restore the electric connection but no fruitful result took place. Having no their alternative, the petitioner filed this case to this Forum for restoration of Electric connection and for compensation of Rs. 43,000/-.
This case is contested by the OP by filing a written objection wherein he denied that the material allegation of the case and also stated that the respondent is always ready to supply the Elec. connection to the petitioner but owing to shortage of Electric pole it becomes beyond the capacity of the respondent and the local Panchayat is also not co-operating to effect connection. Over and above local people is preventing the obstructing in electric connection in favour of the petitioner out of grudge.
Under the circumstances, the Op prays for reject the petition with cost.
Points for decision
On the basis of the above pleading of the parties, the following points are taken up for consideration.
- Is the case maintainable?
- Has the OP failed to reconnect the Electric line in the House of the complainant?
- Is there any deficiency of service on the part of the OP?
- Is the complainant entitled to have any relief as claimed?
Decision
- It is admitted by the OP that the complainant is the consumer under him. It is also admitted by him in the written statement that he is ready to give electric connection. Under the circumstances, it can be said that the case is maintainable in the present force.
- It is the case of the OP that he failed to give electric connection due to shortage of pole and obstruction by the people so we can see that the OP failed to give electric connection as claimed by the complainant. Thus this point is disposed of accordingly.
- It is the case of the complainant that the OP has not given electric connection in spite of direction by the Grievance cell of the Electricity Department.
Exibit.(1). The order of the redressal of the Electricity Deptt. As well as exibit (2) proves that there is specific direction of the Grievance cell of the Electric Department of restore Electric connection in the hose of the complainant, but in spite of order the OP to do so. Again it is the reconnection of the Electric pole not a new connection, so the question of fixing pole seems to be not necessary. Moreover, the OP also has not placed anything showing the line for which it can be the pole is required for the purpose. Under the circumstances, we can say that the OP violated the direction of the Grievance cell of the Elect. Department and also deprived the complainant from having electric reconnection by restoration of the line in question.
Thus this point disposed of in favour of the complainant.
Point No. 4 On the basis of the foregoing discussion and material on record, we are of opinion that the complainant is entitled to have restoration of Electric connection at his house and also compensation for such harassment.
Hence,
Ordered
That the case be and the same is allowed on contest against the OP. The complainant is entitled to have restoration of Electric connection and compensation of Rs.5,000/- from the OP. The OP is directed to comply the above order by one month from this date failing which the complainant is entitled to execute the same by proper court of law. The Electric Dept. if required, the Police help may be taken from Pataspur P.S. the OC/ Pataspur is directed to provide police help to the Electric Department in restoration of Electric connection in the house of the complainant.
