ORDER

One Sumita Garai of Vill. Mayureswar, P.S. Mayureswar, Dist Birbhum has filed an application U/s 12 of the Consumer Protection Act, 1986 (as amended up to date) against the O.Ps  to pass an order directing the Ops not to disconnect the electric supply of petitioner vide consumer Id No. 501289249 till the disposal of this case and for other relief. Total valuation is less than Rs. 5 Lacks. Filing of postal order is exempted in view of amended rule 9A of Consumer Protection Rule 1987.                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                             The case has been filed in time. Register it. Full requisites have been filed.

            The case is taken up for admission hearing as interim petition is filed.

Perused the Complainant and documents.

            Heard.

            We find prima facie case.

Let the case be registered.

The petitioner also files a petition praying for passing an interim order directing the O.P not to disconnect the electric line being Consumer Id No. 501289249 meter No. 18653227. The petition be treated as M.A/30/2019.

Heard. Perused the petition filed by the Complainant and documents. Heard LD. Advocate/Agent of the Complainant.

We find that the petitioner is the consumer under Ops for enjoying electricity vide Consumer Id No. 501289249, Meter No. 18653227 as domestic connection since 2016 onwards, which she got from the Ops after verification and after submitting proper documents and has been paying electricity bills regularly to the Ops and at present no amount is due.

We further find that the petitioner surprised after received letter/notice from the OP No. 1 dated 27/02/2019, that outstanding amount of Rs. 27127.23/ due in connection with Consumer Id No. 522136729 and directed to pay the total outstanding amount within 15 days from the date of issuing the above letter/notice, falling which petitioners present connection i.e. consumer id No. 501289249 will be disconnected by the Ops. The petitioner paying regular bills to the Ops and at present there is not outstanding bills, but they are not ready to listen anything from the petitioner, and threaten to the petitioner that if see is not pay the outstanding amount to Rs. 27127.23/ Id No. 522136729 then there staff will go to her house to disconnect her electric line.

That the petitioner is the consumer under Ops vide Consumer Id No. 501289249 not the consumer of Consumer Id No. 522136729 and if any due/pending bills left that should be recovered from that person i.e. consumer of Consumer Id No. 522136729 and the petitioner is not liable for that so the notice send by the OP No. 1 to another person for pay outstanding bills who is not the consumer of the electricity connection is

 

 vague and not binding upon the petitioner.

That the petitioner is a house wife somehow manages to run her family with the help of her family members and suffering from so many various ailments and after received letter/notice from the OP No. 1.

That the petitioner requested the Ops not to order for disconnection of the valid connection of petitioner for illegal reason, but the Ops are denied to listen anything from the petitioner for their wrongful gain and for that petitioner have no other alternative, but to file a suit against the Ops for restraining them from disconnection of the electric connection of petitioner.

At this stage without going into merit of case we thing electricity is most essential part of the human life in the present day situation.

So, after hearing the petition and verified the documents it appears that the Consumer being Id No. 522136729 is a another consumer and his bill amount is Rs. 27127.23/ which is totally mismatch to the petitioner i.e. Sumita Garai being Id No. 501289249 and she is paying regular bills and the petitioner is not  liable to pay this amount.

Accordingly the Ops are directed not to disconnect the electric line of the Complainant being Id No. 501289249 Meter No. 18653227.

The complainant is also directed to pay the current bill month by month/quarterly.

Accordingly prayer for interim order (ad interim) is allowed till 12.04.2019.

Let copy of this order be supplied to the complainant at free of cost.

Let the copy of the order be sent to the OPs by speed post for compliance.

Thus MA is disposed of.

Fix. 12/04/2019 for S/R and appearance.
