Both parties file hazira through advocate.

The case is taken up for final disposal.

Ld. Advocate for the O.P. has drawn attention of the Commission that written version has already been filed in this case and the case is ready for argument.

The Complainant’s case is that he obtained orders from this Commission in C.C. No.29/2013 and C.C. No.55/2014 which were passed on 24/10/2013 and 16/12/2014 with the directions to pay the fresh bill amount issued by the O.P. and he has approached this Commission by filing the instant 3rd case of similar nature to enforce the above mentioned two orders.

The O.P. contested the case by filing a written version contending inter alia that the orders passed in the aforesaid C.C. cases have been duly complied with and the Complainant has no cause of action to file the instant case.

-: Decision with reasons: -

Having regard to the facts of the case, contention, submission and documents on both sides the Commission finds that the Complainant has filed the instant case for enforcement of the orders dated: 24/03/2013 and 16/12/2014 passed in C.C. No.29/2013 and C.C. No.55/2014 respectively regarding payment of electric bills and those disputed electric bills involved in the aforesaid two cases are the subject matter of the present case. The Commission cannot make fresh adjudication in respect of the disputed bills which were subject matter of the aforesaid two complaint cases. So the instant complaint case is totally misconceived and liable to be dismissed.

Hence it is ordered……..

That the instant complaint case is dismissed on contest but without cost.

Both parties be supplied copy of this Judgement free of cost.
