 FINAL ORDER / JUDGEMENT

Order No.32

Dated:28-08-2023

Both parties file hazira through advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder:-

The Complainant’s case is that he has a submersible pump connection with previous Meter No.LT501418 which was subsequently replaced by Meter No.YX014838 and before replacement of the defective Meter electric bill for the Month of October, 2015 and November, 2015 was sent wrongly and even after installation of new Meter the electric bill for the Month of June, 2016 was also found to be wrongly sent by the O.P. The Complainant has filed the instant case for relief on those three electric bills.

The O.P. contested the case by filing a written version contending inter alia that all the disputed bills have been rectified after installation of the new Meter and the Complainant has already paid all the dues of the outstanding bill up to 31/12/2018 in Duare Sarkar Camp and as such the present case is not maintainable.

                                                                                                                                                                                   Contd……p/2

                                                                                                         Page: 2

-: Decision with reasons: -

At the time of hearing Ld. Advocate for the Complainant has submitted before the Commission that he has no information about the payment of outstanding dues by his client in Duare Sarkar Camp but he urges the Commission to pass necessary order on the basis of the submission of the O.P.

The Commission finds no case made out against the O.P. in the given facts and circumstances of the case.

Hence it is ordered……..

That the case is dismissed on contest but without cost.

Both parties be supplied copy of this Judgement free of cost.
