Shri Sudip Majumder- President-in-Charge.

Today is fixed for hearing of the petition dated 04/12/2023 filed by the complainant and W/O if any.  Both parties are present. Complainant is also present himself.

The petition dated 04/12/2023 filed by the complainant for restoration of his electricity line is taken up for hearing treating the same as M.A. Case No. 55/2023.

The OP/WBSEDCL has contested the application without filing any written objection.

Heard both sides. Objection raised by the OP side.

We find that an interim order was passed on 22/02/2022 direction the OP was directed not to disconnect the line being Consumer ID No. 500836464. But the OP disconnected the electric service connection of the complainant being ID No. 500836464 electric service connection of the complainant violating the ad-interim order dated 22/02/2022 passed by this District Commission.

It appears from the case record that the OP issued an electric bill i.e. included the outstanding of challenged bill dated 15/10/2023 amounting of Rs. 75,757/- to the complainant.

In this juncture without going into the merit of the case we think Electricity is most essential part of the human life in present day situation. Moreover, the complainant is depending upon the present electricity connection to run submersible pump situated at his agricultural land i.e. for his livelihood.

Hence, we think prayer is to be allowed.

Hence, it is,

                        ORDERED,

                                                the petition dated 04/12/2023 filed by the complainant for restoration of his line i.e. M.A. Case No. 55/2023 is allowed on contest. No cost.

The complainant is directed to pay Rs. 15,000/- to the OP/WBSEDCL within 7 days from this date of order and Rs. 35,000/- is to be paid within 7 months in equal installment. And the rest amount of the bill will be adjusted at the time of adjudication of this case.

 The OP/WBSEDCL is directed to restore electricity connection being Consumer ID No. 500836464 of the complainant within 4 days after the receiving the amount of Rs. 15,000/- from the complainant, positively. OP is also directed to issue bill month by month/quarterly without generating the challenged bill or outstanding bill.

The complainant is also directed to pay the current bill month by month/quarterly in respect of this service connection.

Thus the M.A. is disposed of.

Fix.  21/02/2024 for filing questionnaires by the OP. Interim order will be effected till the date.

Copy of this order be supplied to the parties each at free of cost.
