ORDER

Today is fixed for admission hearing. Complainant files hazira through his Ld. Advocate. Heard, perused the complaint and documents. It appears to us that prima facie a case has been made out against the Ops.

Let, the case be admitted.

Requisites at once.

The complainant/petitioner files a petition U/S 38 of the C.P Act 2019 is being registered treated as  M.A Case No. 09/2022. For getting of interim order and injunction to restore the electricity.

Hence, the electricity connection in the premises of the complainant being Consumer Id No. 521116504 on a close scrutiny of the complainant/petitioner as well as the interim petition, it appears that the complainant is a  Consumer being Id No. 521116504 under the OP/WBSEDCL. He sent to pay the bill regularly  in alleged that all on a sudden a bill has been sent to the complainant by the OP demanded a sum of Rs. 23,980/- along with LPSC of Rs. 9410/- which is exorbitant. There after disconnected the electric connection of the premises in question of the complainant without prior notice.

Hence, this application U/S 38 of C.P Act 2019 has been filed by the complaint with a prayer to restore the connection in the premises in question of the complainant.

On a close perusal of the materials on record this Commission is of view that the electricity/WBSEDCL has no authority to disconnect the connection of any premises without given any prior notice when electricity connection is considered as an essential service. At the same time this Commission is not unmindful about the fact that each and every consumer should enjoy the essential service after paying the required charge.

In the instant case as it is alleged before this Commission by the complainant that the electricity bill in question of a sum of Rs. 23,980/- along with LPSC of Rs. 9410/- is exorbitant one so the complainant could not be able to pay the same in time. Considering such circumstances this Commission

 

 

is of view to direct the OP/WBSEDCL to restorer the electricity connection in the premises in question of the complainant on receipt of 50% of the disputed bill amounting to Rs. 23,980/-.

Hence,

            Ordered,

                        That the prayer for restoration of the electricity connection in the premises in question of the complainant as prayed for in the application U/S 38 of the C.P Act 2019 is hereby considered and allowed exaprete.

Fix. 27/06/2022 for hearing. Written Objection if any in the meantime.
