Today is fixed for admission hearing. The Complainant is found absent on call. The record shows that no step was taken by the Complainant from the date of hearing admission i.e. on and from 13.07.23. The record further shows that the Complainant was absent on 20.07.23, 01.08.23 and today i.e. on 08.08.23.

 

             The case of the Complainant as per materials on record is that Electric connection C(T) STIS, consumer I.D. No. 302135283, meter no. STB 14102 installation no. 9610562, stands in the name of the Complainant and in his premises and he is paying bills as per meter reading regularly. The Complainant consumed average 400 to 500 unites per month in the sessional period and he used to pay the claimed amount to the O.P. after receiving bills regularly up to March, 2019. Thereafter, the Complainant stopped consuming electricity from this meter as it became defective. But, despite the presence of a defective meter, the O.P. consistently sent bills to the Complainant without meter readings.

          We peruse the materials on record. It is alleged by the Complainant in the complaint that meter became defective in the year 2019. But we do not find any copy of complaint lodged with the OP regarding defective meter. Moreover, we find that the cause of action arose in the year 2019 and the complaint was filed on 04.07.23. Here we find the complaint before this District Commission was filed after the expiry of two years from the time of cause of action. The complaint is also barred by limitation.

            In view of the matters discussed above we are of the view that the instant case is not require to be admitted and as such it is required to be dismissed.

   In the result, the Consumer case fails.

         Fees paid are correct. Hence, it is

            Ordered

 

that the complaint Case No. CC/81/23 be and the same is dismissed on merit against the OP.

        Let plain copy of this order  be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand  /by post under proper acknowledgment  as per rules, for information and necessary action.
