This Execution Application has been filed by the D.hr/ Debabrata Roy u/s 25 of the C. P. Act. Act, 1986 for getting the ex-parte final order dt. 31.07.2014 implemented by the J.dr.
From the Order No. 8 of this case, it is evident that the J.dr appeared on 25.7.15 by filing Vokalatnama. The J.dr also filed a petition praying time to file written objection. The prayer was allowed fixing 17.9.15 for filing written objection.
Since then several opportunities have been given but no steps were taken by either side.
From the conduct of the D.hr, we are of the view that he is not interested to proceed with this Execution Application any more.
In this situation, we have no other alternative but to dispose of the Execution Application for non-prosecution.
Hence,
Ordered
that the Execution Application No. 22/2014 be and the same is dismissed for non-prosecution.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
