In terms of testing report of the disputed electric meter installed in the premises of the complainant, it has been found by the Divisional Engineer ( Electrical) D.T.D, W.B.S.E.D.C.L, Superintendent Engineer D.T.D, W.B.S.E.D.C.L and Chief Engineer D.T.D, W.B.S.E.D.C.L, that meter accuracy at different loading condition are found in order. Complainant has not been able to counter the allegation in other words failed to prove recording of inflated meter reading.
Therefore, the reports submitted by the authority of West Bengal State Electricity Distribution Company Limited under Order 26 Rule 10(A) of the Civil Procedure Code Read with 26 of Consumer Protection Regulation, is deemed to be relied upon as scientific investigation has been done by the Electrical Engineer holding the responsible post of the West Bengal State Electricity Distribution Company Limited. Therefore, the Expert Report be treated as evidence.
Moreover, it has been admitted by the complainant that the W.B.S.E.D.C.L. Authority has already given benefit of 729 Units electricity in other words exempted charge of 729 electric units.
Therefore, there remains no question to entertain the case and as such there is no merit in the case.
Accordingly the case be dismissed. Report dt. 25.09.2019 issued by the Divisional Engineer ( Electrical) D.T.D, W.B.S.E.D.C.L, Superintendent Engineer D.T.D, W.B.S.E.D.C.L and Chief Engineer D.T.D, W.B.S.E.D.C.L do from part of the order.
