FINAL ORDER / JUDGEMENT

Both parties filed Hazira  through Advocate.

The case is fixed for argument.

Heard argument from both sides.

The Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he is a bona fide customer having Consumer I/D No.233052407 with Meter No.RSX73023 (Non-domestic) used namely for irrigation purposes. While consuming electric power, so, the complainant received outstanding Invoice No.430000624024, dt.25-08-2014 for Rs.1,39,551/- for the month of July, 2014 with Meter reading date on 07-08-2014.

Complainant has challenged the veracity of the said electric bill with the direction upon the O.P. WBSEDCL to issue fresh bill as per actual consumption.

The O.P. contested the case by filing a written version denying alls the allegations made in the written complaint and praying for dismissal of the case.

Having regard to the facts and circumstances of the case and the submission and contention on both sides the Commission finds that it is a case of excessive billing for electric consumption by the complainant for the year 2014 and now it is 2023 and naturally it is difficult for the Commission to verify the basis of the disputed bill by any mechanism. In such case a Golden rule is to be applied   to assess the electric consumption on the basis of average consumption for the preceding and succeeding bills on an average throughout the year. It appears from the record that the Complainant has already paid Rs.69,775/- by receipt dated: 30-09-2014 towards the said outstanding bill of Rs.1,39, 551/-. The complainant has been paying bills thereafter without any objection. Thus the entire grievance centres round the disputed outstanding bill and in absence of actual data of consumption no liability can be fixed upon the complainant for payment of the balance outstanding dues.

The case is disposed of with the finding that the complainant has no further liability to pay to the O.P. towards balance outstanding bill of Rs. 1,39,551/- and the O.P. be restrained from taking any action for disconnection of the Electric line of the complainant accordingly.

Both parties be supplied copy of the order free of cost.
