Considered above facts & circumstances we do not find any impediment to dispose of this case on the basis of prayer made by the Complainant.

Accordingly, we pass the following order.

That the Complainant be and same is hereby dismissed for non-prosecution but without cost.

Thus the case is hereby DISPOSED OF.
